Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you and Outstanding AI ("we", "us" or "our"), which operates the Outstanding AI meme video service at www.outstandingai.net and its related services (together, the "Service").

By creating an account, purchasing a video pack or otherwise using the Service, you agree to these Terms, our Privacy Policy, Cookie Policy, Refund Policy and Content Policy. If you do not agree, do not use the Service.

2. What the Service does

Outstanding AI is an online AI meme video generator. You choose a meme template inspired by a trending short-video format, upload one or more photos, optionally add a short text note, and our AI models generate a new short video ("Output") that you can preview and download.

The Service is a digital service delivered entirely online. No physical goods are shipped. Generated videos are usually delivered within a few minutes in your browser and in your account history, although processing time can vary with demand.

We may add, change or remove templates, models and features over time. AI results are probabilistic: the same inputs can produce different results, and Output may not match a template exactly.

3. Eligibility and accounts

• You must be at least 18 years old, and old enough to form a binding contract where you live.
• You sign in with a supported provider (such as Google). You are responsible for keeping access to that account secure and for all activity under your Outstanding AI account.
• You must give accurate information and must not create accounts to evade a suspension, abuse free generations or promotions, or pretend to be someone else.
• One person may not operate multiple accounts to obtain additional free generations.

4. Generations, video packs and payments

Generating a video uses 1 generation from your balance: every video uses exactly 1 generation, whatever the template, quality, aspect ratio or length you choose. The cost is shown on the Generate button before you confirm, and failed or blocked generations are not counted.

• Prices and included generations are shown on our Pricing page before checkout. Prices are in US dollars unless stated otherwise; applicable taxes may be added at checkout.
• Video packs are one-time purchases. You are charged once at checkout; packs never renew and you will not be charged again unless you buy another pack.
• Generations from one-time packs are added to your account right after payment and never expire. Generations have no cash value, cannot be transferred, and cannot be exchanged for money except as described in our Refund Policy.
• We may change pack prices or contents in the future. Changes never affect packs you have already bought.
• Our checkout is provided by Waffo (Waffo.com Limited, Hong Kong), our online reseller and merchant of record. Waffo is the seller of record for your order: it processes the payment, issues the receipt, calculates and collects any applicable sales tax or VAT, and handles payment-related refunds and chargebacks. Waffo's Buyer Terms (www.waffo.ai/buyer-terms) apply to the payment, and "Waffo" may appear on your card statement. If a different payment partner is shown at checkout, that partner's terms apply instead. We never see or store your full card number.

5. No subscriptions or automatic renewals

Outstanding AI does not currently sell subscriptions, so there is nothing to cancel and no recurring charges. If we offer subscription plans in the future, we will clearly show the billing interval and renewal terms before checkout and let you cancel at any time from your account.

6. Your photos, notes and generated videos

"Your Content" means the photos and text you upload or enter, and the Output generated for you. As between you and us, you keep any rights you have in Your Content.

You grant Outstanding AI a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Your Content solely to operate, secure and provide the Service to you (for example, sending your photos to an AI model provider to generate your video, and storing the result so you can download it). We do not use your photos or videos in our marketing, and we do not sell them.

Subject to these Terms and our Content Policy, you may use Output you generate for personal and commercial purposes. You are responsible for how you use and share Output, including complying with the rules of any platform you post it to.

7. Consent and photos

Before you upload a photo, you must confirm that you own it or have permission to use it, and that every identifiable person in it (including you) is an adult who has agreed to appear in an AI video. You must not upload photos of minors, of public figures or celebrities, or of any person without their consent, and you must not use the Service to make videos of other people without their agreement or to pretend to be them, harass, defame or deceive anyone.

You must not present Output as real footage of an event that did not happen, or use it to mislead people about who said or did something. Where a platform or law requires it, you must label Output as AI-generated.

8. Acceptable use

You agree to follow our Content Policy. In short, you must not use the Service to create or share sexual content, content involving minors, violent or hateful content, non-consensual or deceptive depictions of real people, content that infringes anyone's intellectual property or publicity rights, or anything illegal. You also must not attempt to break, overload, scrape or reverse-engineer the Service, or bypass generation limits or safety filters.

We use automated and manual checks on uploads and prompts. We may block a generation, remove content, or suspend or close accounts that break these rules, and we may report illegal content to the authorities.

9. Templates and third-party trends

Templates are original AI prompt designs inspired by popular short-video formats. Outstanding AI is not affiliated with, endorsed by or sponsored by TikTok, Instagram, any other platform, or any artist or creator. Trend names are used only to describe a style. Templates do not include copyrighted music; if you add music or other material to Output, you are responsible for having the rights to it.

10. Our intellectual property

The Service, including our software, website design, templates, logos and the Outstanding AI name, belongs to Outstanding AI or its licensors and is protected by law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. You must not copy, resell or build a competing service from it.

If you believe content on the Service infringes your rights, email contact@outstandingai.net with the details described in our Content Policy and we will review it promptly.

11. Suspension and termination

You may stop using the Service and request deletion of your account at any time by emailing contact@outstandingai.net. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. If we terminate your account without cause, we will refund any unused prepaid amount for the current period. If we terminate it because you breached these Terms, unused generations are forfeited where the law allows.

12. Disclaimers

The Service and Output are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that any template will remain available, or that Output will meet your expectations. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, Outstanding AI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50. These limits do not apply to liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

14. Indemnity

You agree to indemnify and hold Outstanding AI harmless from claims, losses and costs (including reasonable legal fees) arising from Your Content, your use of Output, or your breach of these Terms or of anyone's rights.

15. Disputes and governing law

If you have a problem with the Service, please contact contact@outstandingai.net first; most issues can be solved quickly. If we cannot resolve a dispute informally within 30 days, it will be resolved by the competent courts under the laws that apply to the operator of the Service, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there.

16. Changes to these terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date, and for material changes we will give reasonable notice (for example, by email or a notice on the site) before they take effect. Continuing to use the Service after the changes take effect means you accept them.
